The GAIC bill has been voted through the upper house and will now become law.

 

Dear Taxed Out member,

The GAIC Bill has now passed through the Upper House. The next step is for Planning Scheme Amendment VC67 to be passed in the Upper House. That is not a foregone conclusion with opposition parties indicating some elements of VC67 require amending.

Should Amendment VC67 be delayed in passing through the Upper House the GAIC legislation will not apply to landholders in the Investigation Areas. It is important to note those landholders will not be inside the UGB and therefore will not incur the GAIC Tax.

It does mean however that property owners currently inside the UGB will become subject to the $80,000 per hectare GAIC liability, with those owning more than 10 hectares, subject to the 30% upfront tax on sale.

It also means that developers who have acquired land in the investigation areas will be unable to develop property until the UGB moves.

The government will not get their GAIC revenue from the Investigation areas until Amendment VC67 is adopted and if coalition amendments are unacceptable to the government it may mean both the GAIC and VC67 become unworkable.

The only upside is that the GAIC will have been passed in a form that protects those selling land under 10 hectares which is far better than the original government proposal. While we resisted strongly to the coalition accepting the GAIC Bill the fact is it has now passed.

The current situation does not satisfy anyone but there is obviously still a great deal of uncertainty. For instance, Matthew Guy confirmed last night in Parliament that the coalition will introduce a GAIC where full payment is at the development stage, if elected. We have to remember that Taxed Out has been successful in changing government policy to the advantage of many of our members, because we have been united.

There is less than 7 months to the next election, so we have time to formulate our response to last night's decision, and decide what steps to take next. Please put your concerns to your committee representatives, so they know what you are thinking, and we will respond to the Government and the Opposition once we have your feedback.

So now we have to live with the GAIC.

The Liberal Party and in particular Matthew Guy have been condemned by many on this site.

We shouldn’t be venting our anger at the Liberals, we should be thanking them.

While this result is not what many of us wanted, the Liberal Party has done the best it could under difficult circumstances.

If the Liberals had not negotiated and the Labor Party were re-elected in November we would have faced the likelihood that Labor would call a joint sitting of Parliament, reintroduce the original bill, force it through and we the landowners would be forced to pay 100% of the GAIC.

Instead of now blaming the Liberal Party for an about face we must remember who were the architects of this GAIC legislation and get behind the Liberal Party and work together to get them elected in November so that the GAIC legislation can be changed to 100% liability at the time the land is rezoned and then paid by the developer.

A protest vote against the Liberals at the November election, where you give your vote to the Greens or somebody else, is simply a vote for Labor and therefore no change to the GAIC.

Use your anger against Brumby and Madden not against those that have tried to help us.

Peter I agree with you. What's done is done - let's now get behind the Libs. Working against them will only increase the likelihood that Labor will get back into power and that is bad news whichever way you look at it.

To Michael and the entire Taxed out team you guys have done a great job and without you many of us would have been in fiancial ruin.

To the Liberals, thank you for all you have done and I appologise for all those times I voted for the Labor criminals.. Never again Brumby.. Libs for me from now on..

And for my last line of contribution I just want to remain professional and respectful as well as polite by saying Minister Madden is a Fu#$*ng d-head.

I totally agree with you Peter, we all knew the deal would be done. We must now keep up the pressure, get behind the Liberals, vote them in in November and get them to live up to their promise of charging the GAIC at point of Development.
Matthew Guy has made that promise to all Landholders so we should get behind him and the Liberals to vote them in.

I totally agree with the previous comments and say Thank you once again to the Taxed Out committee for their tireless efforts. I am ready to walk my legs off letterboxing before the election. We must educate the electorate a few crumbs at a time.

You people have all been Conn cant anyone see that the liberal party will support labor in getting VC67 rectified Because if they don't labor will use it against them at the next election its just 1 big Conn
